Surprise....Civil Suit filed against Kobe.

Apparently Kate Faber may be getting cold feet about a criminal trial....Filing a civil suit would allow her to drop the criminal trial, thus virtually sparing Kobe jail time.

Another note about this......... with a civil suit, Kate Faber is no longer protected by the rape sheild law.

Thus, all evidence of her past, as well as her identity, will become public.


So look for all sorts of gory details to spill out into the media soon after regarding this case and Kate Faber.

DENVER -- The 20-year-old woman accusing Kobe Bryant of rape filed a federal civil lawsuit against the NBA star Tuesday, seeking unspecified damages for pain, suffering and "public scorn, hatred and ridicule."


 
 
The attorneys asked for a jury trial and compensatory damages of at least $75,000, with punitive damages to be determined later.


With the filing, the woman's attorneys backed up a threat they made a week ago. A criminal case requires a higher standard of proof to convict -- beyond a reasonable doubt -- and punishment can involve prison time. A civil case has a lower standard of proof -- a preponderance of evidence -- and punishment is usually a monetary award.


Bryant 25, has pleaded not guilty to felony sexual assault. He has said had consensual sex with the woman, then 19, at the Vail-area resort where she worked last summer. The Los Angeles Lakers star faces four years to life in prison or 20 years to life on probation, and a fine of up to $750,000 if convicted. Jury selection begins Aug. 27.


Bryant's defense attorney, Pamela Mackey, did not immediately return a message seeking comment and neither did the woman's attorneys, John Clune and L. Lin Wood. All attorneys in the case were reminded by the judge last week that a sweeping gag order is in place.


However, the woman's attorneys laid out generally the same case against Bryant as have Eagle County prosecutors: That Bryant attacked her in his room at the Cordillera resort, causing her emotional and physical problems that linger to this day.


"The conduct of defendant Bryant demonstrates willful, reckless and intentional criminal conduct and that entire want of care that raises a conscious indifference to consequences," the attorneys wrote.


Prosecution spokeswoman Krista Flannigan said the civil lawsuit changes nothing for prosecutors.


"We are still moving forward," she said. She declined comment when asked whether the civil case could complicate the effort to win a conviction.

I'm waiting for the Micheal Moore version.

I figured the money grubbing ho was going this route after the transcripts were released concerning the motile sperm found on the ho bag.

God, I hate it when money gets involved.  It clouds up the picture, and calls motives into question.

Had the civil suit come first, I'd completely question the girl's story.  The fact that the civil suit hasn't come until now, however, makes me tend to believe that whatever went on in that hotel room wasn't just adultery on one side and extortion on the other.

But given the way things have gone during this court hearing, a civil suit should have been filed.

A civil suit should be filed against the clerk of the court as well.  The "mistakes" made have been suspiciously one-sided and damaging.  The conspiracy theorist in me makes me wonder if BRIBERY hasn't been involved.

The gory details of their encounter have already been released to the gory public, Dog. It was in an ESPN special regarding the incident, complete with a warning that the contents of the show may not be suitable for young dogs.

It also covered the incident at Shaq's house in Florida, regarding the women there who got her gropes up from Kobe.

Ms. Faber needs a civil court victory to ensure her tell-all tome about where Kobe likes to get his wiggle on ends on a winning, tearjerking, happy note, so women can buy it up and can read it with smug smirks on their faces as their significant others wonder what they have done wrong now.

To me this looks REALLY bad for her and for the DA.  Not because it looks like she just wants money...but because it makes it seem like the client has given up the chance of getting Kobe where it hurts.  On top of that today I saw on MSN.com that the DA and his team is stalling for time.

She will win the civil suit because they just need to prove that all of this has had a negative effect on her, which it has.  However, If the evidence checks out wouldnt a strong case be made that she brought it onto herself?  Or does that not matter?  Randy seems to know alot more about this than anyone else.

Yes all her personal info, idenity, and anything else is going to become public.......but what makes that any different from now?

It's come down to "he said/she said" because of the motile sperm.  No ALL of the physical evidence is moot.  The vaginal tears and bruise can be thown out the window because she was ho'ing around and you can't pin the SLIGHT injuries on Kobe anymore.

The "mistakes" have hurt the accuser but the attempted hidding of evidence has been on the DA.  Trying to supress evidence AND testimony of HIS OWN crime lab stinks like shhhhhh.....

Kobe will be the victim when this is said and done. A poor victim at that.  He's guilty though. Just like Scott Peterson is guilty. Not enough evidence though, have to let them go.
