What does daylight gathering have to do with..?

ESPN:  The defense has argued that Bryant was essentially in custody when he was questioned by the two detectives. Defense attorney Hal Haddon has also said Colorado court rules call for hair, fibers and other "non-testimonial evidence" to be obtained during daylight hours. Bryant's hospital exam was performed before dawn July 2.


Winters has said he didn't know about the daylight rule. He also admitted a judge had to remind him he needed two separate court orders to gather evidence: one for hair and similar evidence, and another for Bryant's clothing, including the bloodstained T-shirt.  end article.


What does evidence gathered in daylight or after sundown have to do with fairness?  To either side Krishnas, unbunch your panties.

Those are the rules, any cop, let alone a detective, should have known that.  It's in place so you can't harass people in the middle of the night.  It's a technicality but then again so are a number of "rape shield law" quirks.

so if the crime does occur in the middle of the night, it would be "harrasing" the poor criminal (not referring to Kobme) to gather the evidense in a timely fashion.  Nope, even if crime occurred in middle of night, evidence may not  be gathered until the next sunup.

I love sleasly defense lawyers and their roolz.

Yes i know prosecuters can be bogus also.

These rules apply to search warrants, anybody who watches Law and Order should now the difference between a search warrent and gathering evidence at the scene of a crime.

Also anybody who seen any crime drama series knows the difference between probably cause and having to obtain a search warrant.  The cops f'ed up royaly in the Kobe case, anybody can see those guys were either incompetent or had a serious agenda/fame bug up their arse.

That doesn't mean Kobe is guilty or innocent, just means that the cops involved are idiots, then again they are cops.

I guess it's obvious you don't understand the way things work.

There is NO rule about NOT searching for evidence at night, you just have to get the proper search warrent.  If you want to search durring the day you get a day time search warrent, if you want to search at night you get a night time search warrent.  Very simple, any cop should have known that and gotten the correct search warrent.  Understand?

Probably cause is going to someone's house and noticing something while you were there standing in the door way (i.e. a gun laying on the sofa within eyesight).  That would allow you to enter the residence/room without a search warrent or without the owners consent.  Going to someone's home/room to actually enter and search for blood/hair evidence requires a search warrant.  Understand?

Simple rules that apply to everyone not just the Lakers.

While what you wrote is simple, i'm not sure this correctly applies to Colorados and other states confusing laws.  Again, read the quote from Kobme Scheme Teamer:

He does not speak of obtaining the warrants during the night.

THAT'S BECAUSE THE WARRANT WAS A DAYLIGHT WARRANT!  HAD THEY OBTAINED A NIGHT TIME WARRENT THERE WOULD BE NO ISSUE!

I don't know that Barney Fife and co should have know this.  Maybe they can now watch Law and Order with you.

Once again i will state that prosecutors also have pissy little loopholes.  But defense in general has way more.  The Criminal Injustice System.

Everyone under the sun has commented that the keystone cops should have known this, especially a detective.  With guys like that running the show it's a wonder anybody ever gets convicted.  It's just plain incompetence.  Not to mention the cops have been caught lying 3 times and have been busted for altering police reports to match their testimony after they've given their testimony.  Guilty or not Kobe is going to walk, if he doesn't he'll have an appeal served on a silver platter.

Why you wasted your time pointing all this out to Reality......god only knows.  The only thing he sees is that "KobME" is going to be in the purple and gold burning whatever team he decides to front run with that year.  He obviously doesn't care about police procedures (sp) and why they are in place.

There is a very good reason why there are seperate times for warrants.  People should be free in their homes, especially at times when people normally are sleeping or handling personal family kinds of things.  They easily could have got the warrant if they explained the the judge what the reason was for.  A simple process that every detective should know.  This isn't going to get Kobe off, dont worry.  What it is going to do is put the question in the jurors mind if the police conducted their work properly.  So far....they have not.  Of course you dont care........that is until of course it happens to you or someone you know.

God and the fact that WOW is intelligent.

Check out his SAT and trade school college scores.

Just cause he doesn't always understand all aspsects of hoop.  Even then he can come out of the house on a regular basis and see Lakerism in objective light.   ;)
