He did not physically touch him.  He farted near him.  The assumption that a drunk guy farted on a cop on purpose is not going to hold up in court.  You could argue it a million ways.   Since there was no harm done, other then having to smell a drunk guys fart for a minute or two, I don't in this instance.  I already think police officers abuse the law with crap like this as it is.  If you piss a cop off he can easily bend things around so you get extra charges and I don't agree with that.  It's just like when a person asks a cop very calmly 'why am I even being arrested' and all the sudden it resisting arrest.  Lame.

Tho I will admit I am bias towards law enforcement out here.  Especially in Orange County where the cops have very little to do and seem to get off being able to justify anything they do or say with bs.

"Officer Parsons was in a chair approximately 4-5 feet away from the fingerprinting station.  The defendant scooted the 4 feet to PTLM Parsons, away of Officer Cook, and lifted his leg and passed gas loudly on PTLM Parsons.  The defendant then fanned the air with his hand in front of his rear onto PTLM Parsons."  

Since some defense liar would no doubt twist away to get Cruz off in court, I've added a "beat down administered" option.

Either way...it's not battery.  He did not touch him.  Was it rude? Sure.  That doesn't mean its battery.
